TERMS AND CONDITIONS
During the period of validity of the Alarm Status or its possible extensions, the deadlines for returns of purchased products are interrupted. Thus, the computation of the deadlines will be resumed at the moment when the Royal Decree declaring the State of Alarm or, as the case may be, the extensions thereof (art. 21 Royal Decree-Law 8/2020) ceases to be in force.
The following Conditions of Purchase are subscribed, on the one hand, by Juguetes Cayro, S.L., hereinafter CAYRO, with registered office at P.I. Juyarco, 54 – 55, 03700 Denia (Alicante), with CIF number: B03021243, registered in the Mercantile Register of Alicante, Sheet A-18.580, Volume 1.542, Folio 174, and on the other hand, by the CUSTOMER.
CUSTOMER means any natural or legal person who purchases a product through this website (tienda.cayro.es).
Likewise, the CLIENT declares that he/she is of legal age and has full capacity to read and understand correctly all the clauses of these Purchase Conditions.
INFORMATION AND DATA
CAYRO reserves the right to modify the contents, product or services marketed from the website, as well as the commercial offers presented at any time.
CAYRO makes every effort within its means to provide the information contained in the web site truthfully and without typographical errors. In the event that at any time an error of this type should occur, at all times beyond the control of CAYRO, it will be corrected immediately. If there is a typographical error in any of the prices shown and a CUSTOMER has made a purchase decision based on such error, CAYRO will inform the CUSTOMER of such error and the CUSTOMER will have the right to cancel the purchase without any cost on its part.
The contents of the CAYRO website may, from time to time, display provisional information on some products. In the event that the information provided does not correspond to the characteristics of the product, the CUSTOMER shall have the right to cancel the purchase without any cost on his part.
CAYRO is neither directly nor indirectly responsible for any of the information, contents, statements and expressions contained in the products marketed by CAYRO. Such liability shall at all times be borne by the manufacturers, producers or distributors of such products. The CUSTOMER understands that CAYRO is merely an intermediary between the CUSTOMER and such manufacturer or distributor.
The cost of taxes (VAT and/or R.E.) and the cost of transport of the products that can be purchased through the website depends on the type of CUSTOMER making the purchase.
- Individuals: The prices shown include the corresponding VAT but do not include transport costs. As this amount depends on the destination, it will be indicated in the shopping cart.
- Professionals: The prices shown do not include taxes and transportation costs. In this case, the amounts will be notified to the CUSTOMER in the pro-forma invoice.
3. COST OF TRANSPORTATION
The cost of transportation for private CUSTOMERS is
- Peninsula: 5.85 (VAT included).
Shipping costs may vary for reasons of weight or dimensions, but will always be communicated in advance with the CUSTOMER who must agree to such modification.
The cost of transportation for the professional CUSTOMER shall be agreed upon when formalizing the corresponding contract.

5. PAYMENT METHODS
- Credit card: Payment by credit card is made through the RedSys virtual POS, secured with MasterCard Secure Code and Verified by Visa systems. These systems, at the time of payment, request a password or other method to validate the authenticity of the card and prevent the use of fraudulent cards or numbers. These keys are requested by the CLIENT’s own bank. If you have any doubts about these securitization methods, you can consult your bank. If you have problems making the payment, you can contact us.
- Paypal: Payment system widely used around the world, where you can associate your bank account or VISA card to a virtual account created in www.paypal.es. Through this platform, PayPal CUSTOMERS can conveniently and securely make their payments. If you are not a CUSTOMER of this platform, you can also pay in our store by credit card.
- The products must keep their original seal intact.
- The CUSTOMER shall bear the shipping costs in case of return, provided that the reason for the return is not attributable to the product received.
- The product to be returned must be properly packaged for return.
7. DEFECTIVE ITEMS
In the event that a CUSTOMER receives a defective item, CAYRO will proceed to replace the same item purchased. If the same article is not available, the total amount paid at the time of purchase will be refunded.
When a defective item is detected, CAYRO will be notified of the problem or defect via email, clearly indicating the condition of the product and how the package was found by the shipping company and the order number.
No returns can be made without first contacting CAYRO. In this case, a carrier will be sent to the CUSTOMER’s address to pick up the defective product and proceed to the replacement of the product, in case of availability.
The CUSTOMER must have the product ready, well packed and properly protected, placing the order number in a visible place outside the box or package.
8. ERRONEOUS ITEMS
In the event that CAYRO sends a product to the CUSTOMER by mistake, it will proceed to withdraw it and replace it with the one purchased by the CUSTOMER, provided it is in stock and has not been opened, manipulated or unsealed. In the event that the item is not available for replacement, CAYRO will proceed to refund the full amount paid, through the same means of payment and within a period not exceeding 14 days from the arrival of the goods at our warehouse.
The costs of collection and replacement shall be borne by CAYRO as long as the error was not made by the CUSTOMER.
9. CANCELLATION OF ORDERS
The CUSTOMER will have the possibility to cancel an order by calling 965 781 482 or writing an email to email@example.com, provided that the order has not yet been sent for delivery.
However, in the event that the Product has already been shipped, the CUSTOMER must wait for the package to be delivered to proceed with its return.
Once the order has been cancelled, the CUSTOMER will be reimbursed the amount paid, preferably in the same way in which the payment was made, minus any expenses incurred.
In accordance with the provisions of Royal Legislative Decree 1/2007, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, all products offered through our online store are, in general, guaranteed by the manufacturer against any manufacturing defect or lack of conformity with the qualities and characteristics that are detailed in the same, except with those exceptions expressly provided in these Terms and Conditions of Purchase.
On the other hand, by virtue of this warranty, which shall have a term of two years from the date of delivery of the Product, the CUSTOMER shall be entitled to have the Product repaired or replaced, at no cost to the CUSTOMER. If it is not possible to repair or replace the Product, or if the option chosen is disproportionate, CAYRO will proceed to reduce the price or terminate the contract.
Deficiencies caused by improper use or handling of the product, as well as by blows, negligence, incorrect handling or installation not carried out by CAYRO technical service, or by the wear and tear of materials due to normal use, are excluded from the warranty. The warranty will also be excluded if any information on the warranty or proof of purchase is modified, altered or replaced.
In no event shall CAYRO’s total liability for any reason whatsoever exceed the total value of the defective or non-conforming product supplied. Nor shall CAYRO be liable, except as provided in these Conditions of Purchase, for any damages for anticipated results, delay or loss of production.
CAYRO does not warrant any benefit or suitability of the product for any use or purpose intended by the CUSTOMER. The CUSTOMER shall, before purchasing the products, carry out the necessary checks to confirm the suitability of the product to its needs and expectations.
CAYRO is expressly exempt from any liability for damages, direct or indirect, including loss of profits, caused to the CUSTOMER or third parties, which may arise from the use or the impossibility of use, professional or private, of the product.
Procedure for claiming the guarantee
The CUSTOMER is obliged to inform CAYRO of manufacturing defects or non-conformities within two months of becoming aware of them.
For any incident, claim or exercise of its warranty rights, the CUSTOMER should contact CAYRO’s CUSTOMER Service Department by email at firstname.lastname@example.org or by telephone at 965 781 482, where he/she will be informed of the procedure to be followed. Likewise, the CUSTOMER undertakes to carry out the steps indicated to make the warranty effective.
In the event that, when the warranty procedure is initiated due to a defect or lack of conformity reported by the CUSTOMER, CAYRO verifies that the products do comply with the contract, all costs incurred as a result of the implementation of the warranty process shall be paid by the CUSTOMER.
11. RIGHT OF WITHDRAWAL
In accordance with the provisions of the regulations protecting consumers and users, the CUSTOMER has a period of 14 working days from the delivery of the product to communicate its decision to withdraw from the contract concluded with CAYRO.
For the proper management of product returns that occur as a result of the exercise of the right of withdrawal, the CUSTOMER should contact the CAYRO Customer Service, where he/she will request the Document of Revocation or Return to present with the list of products to be returned. The CUSTOMER Service will send you an email or electronic confirmation with the receipt of the return request, an RMA (Return Merchandise Authorization) number and the corresponding instructions on the process to follow and the deadlines to carry out the return. The CUSTOMER shall keep the receipt as proof of the return request.
Returns will be made exclusively through the carrier indicated by CAYRO, which will transport it to the address indicated for this purpose. Shipments without prior written authorization of products or deliveries sent directly to CAYRO’s warehouses will be refused. The CUSTOMER shall be responsible for the proper delivery of the product to the carrier.
The product must be perfectly packed in order to avoid incidents or damages during transport.
The CLIENT declares that he/she is aware that the direct costs of return will be borne by the CLIENT.
The cost of the return transport will be the same as the one charged for the shipment of the purchased products. In case of partial return of the order, you will be charged the transport costs corresponding to the price (including taxes) of the returned products at the rate in force at the time.
The CUSTOMER also declares to be aware that any damage to the products returned as a result of the exercise of the right of withdrawal that has not been noted at the time of delivery, will be presumed to have been caused by his fault or negligence, being the CUSTOMER responsible for them. In addition, for the return to be accepted, the product must be in perfect condition. The CUSTOMER shall be responsible for any damage suffered by the products during transport.
The product must be returned with all its accessories, documentation, instruction manuals (if any) and in its original packaging. In case any of them is missing, the product will be returned to the CUSTOMER’s address, at the CUSTOMER’s expense, with a note indicating the items that may be missing.
Likewise, the duly completed original return form must be attached together with a copy of the delivery note or invoice in the event that, at the request of the CUSTOMER, the latter has been issued.
Reimbursement of the price paid by the CUSTOMER
The reimbursement of the price paid by the CUSTOMER will be made within a maximum period of 14 working days. In any case, the amount reimbursed will be the result of subtracting from the price paid for the product, the costs originated by the transport of the product, both outward and return, as well as any other expenses incurred (bank commissions, commission on cash on delivery, etc.). The CLIENT will receive the corresponding amount preferably by the same means in which it was paid.
12. EUROPEAN PLATFORM FOR ONLINE DISPUTE RESOLUTION
We inform you that if you are a resident of the European Union, you have the possibility of using the ODR (Online Dispute Resolution) platform through the following link.
Through this platform, consumers and traders are allowed to submit complaints through an electronic form available in all languages of the European Union, for all matters related to e-commerce or provision of services on the network, as provided for in Regulation 524/2013 of the European Parliament and of the Council of 21 May 2013 and Directive 2013/11/EU of the European Parliament and of the Council on alternative dispute resolution in consumer matters.
13. APPLICABLE LAW AND JURISDICTION
The possible total or partial nullity of any of these Conditions of Purchase shall not affect the validity of the contract itself, and the will of the parties shall be integrated with respect to the null clause, and the rest of the Conditions shall be fully applicable.
These Conditions of Purchase shall be governed by and construed in accordance with the laws in force in Spain, which shall apply subsidiarily in all matters not provided for herein.
The parties submit to the courts and tribunals of Dénia (Alicante) for the resolution of conflicts, renouncing any other jurisdiction.
IMPORTANT: YOUR ORDER IS A CONTRACT
According to the Ministerial Law of electronic commerce 34/2002 any purchase made through the Internet must be accepted, and must be made by persons of legal age. If you are not 18 years old, your parents will be responsible for the order. In case it is rejected and returned we will contact you or your parents and you will have to pay the amount of the order plus the return, courier and administration costs. Think carefully about what you are going to order; if you have any doubts, send an e-mail to email@example.com or call 965 781 482 before placing the order, because once you have placed it, you will have to accept it.
CAYRO reserves the right to reject or cancel any order in case of any type of error beyond our responsibility or in case of bad faith on the part of the CUSTOMER.
